Recently, we completed a multi-part blog series discussing the probate process in California. We looked at how the court interprets a will, the formality with which a will must be completed and administered, and finally, the extraordinary cost your estate must bear to administer a probate. Let’s be honest, people don’t like to discuss their own mortality. But two things are certain in life: death and taxes. Why not take the time to prepare properly?

The thing is – in California probate can largely be avoided. There is no need for a family to have to go through the probate process in order to transfer assets to a spouse or children or whomever one elects as a beneficiary.

The headaches of crowded court dockets and delays created by the necessity of court approval for distributions do not have to be part of your estate plan. With a little planning, you can craft a plan that should largely avoid the necessity of court intervention. You can be creative in how you want your affairs handled. Maybe you want to set aside some money to allow your family to take a trip together. Or maybe you want to set aside money for a nice dinner for the family. Maybe you have specific wishes for how you want to be laid to rest. You, rather than the Court, can direct who will take care of your children, should the unthinkable happen. Your choices are endless if you take the time to create a proper trust and pour-over will.
